Wordmark registration is the process of registering this text-based mark under the Trade Marks Act, 1999 with the Trade Marks Registry of the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) in India.Any business that wants to secure exclusive rights over its brand name should register a wordmark. This includes proprietorships, partnerships, LLPs, companies, startups, trusts, individuals, and even foreign applicants. Because a wordmark protects the word itself, the protection follows the name in every form — across packaging, advertising, websites, and any future redesign of the logo.

India follows the international NICE Classification, which divides all goods and services into 45 classes. What is the difference between a wordmark and a logo (device) mark?+
A wordmark protects only the brand name or text, regardless of font, colour, or style, so the protection covers the word in every visual form. A logo or device mark protects the specific artwork or design as a whole. A wordmark generally offers broader protection for the name itself, while a logo mark protects only that particular design.
Who can apply for wordmark registration in India?+
Any person or entity can apply, including individuals, proprietorships, partnership firms, LLPs, companies, startups, trusts, and foreign applicants. There is no turnover or business-size requirement. Foreign applicants must provide an address for service in India, usually through a registered trademark agent or attorney.
How long does a wordmark registration remain valid?+
A wordmark registration is valid for 10 years from the date of application. It can be renewed indefinitely for further periods of 10 years each by filing a renewal application and paying the prescribed government fee, so the protection can continue for as long as the mark is renewed.
When can I use the ™ and ® symbols?+
The ™ symbol can be used as soon as a trademark application is filed and is pending, to indicate that rights are being claimed. The ® symbol can be used only after the trademark is officially registered. Using ® before registration is not permitted.
Should I register a wordmark or a logo first?+
Many businesses register the wordmark first, because it protects the core brand name in any form and remains valid even if the logo is later redesigned. The logo can then be registered separately as a device mark to protect its specific artwork. Registering both gives the most complete protection.
